Pre-launch phase

Dalim is in its pre-launch phase: the service is not yet commercially open, no payment is collected and no purchase can be made on this site to date. Signing up during the pre-launch is simply an expression of interest, with no commitment. The publishing company is being incorporated: this document will be completed and consolidated upon registration, before any commercial launch.

1. Purpose

Dalim is a B2B service that produces and hosts 3D virtual tours for real-estate professionals. These terms describe the service as it will operate at commercial launch. During the pre-launch phase, no sales contract is concluded online and no payment is collected; signing up is an expression of interest, with no commitment. A consolidated version of these terms will be published when the publishing company is incorporated, before the commercial launch.

2. Access to the service

Access is by invitation (pre-launch code). The account is reserved for professional use. The account holder is responsible for keeping their credentials confidential and for how their team uses the account.

3. Subscription and billing

The current plans and prices are set out on the Pricing page. Billing is based on the number of active tours, that is, the properties published online at the same time; scans (captures) and user accounts are included without any limit on number, within normal professional use (see the “Fair use” article). Prices are exclusive of tax; VAT is added. Unpublishing a tour immediately frees its slot; a property unpublished for more than 90 days is archived and stops counting while remaining privately viewable. Exceeding a plan's active-tour cap does not trigger per-item billing: it invites an upgrade to the next plan. At commercial launch, card payments will be handled by our provider Stripe; Dalim will store no card data. During the pre-launch, no invoice is issued and no payment is collected: the prices shown are those reserved for registered users, and will apply only from launch, after the customer's explicit confirmation.

4. Fair use

“Unlimited” scans and user accounts mean normal, good-faith professional use, related to the customer's real-estate activity and within the technical capacity of the service. To guarantee quality and availability for all customers, Dalim applies proportionate measures against abnormal or abusive use: a cap on the number of concurrent and daily processing jobs per account, deduplication of identical captures (the same file is not processed twice), and temporary slowing of the processing queue in the event of manifestly abnormal use (for example a volume of captures unrelated to the number of properties actually listed).

These measures are reversible and never automatically suspend an account. Any lasting restriction or suspension is preceded by a discussion with the customer. Good-faith use is never affected.

5. Service level

Dalim aims to publish tours within 4 business hours of receiving a compliant capture. During the pre-launch this is a service objective, not a contractual guarantee backed by penalties. Turnaround may vary with volume, the size of the property and the capture conditions.

6. Accuracy of tours and measurements

3D tours, along with any distances or areas shown in the viewer, are produced automatically and provided for guidance only. They do not constitute a regulatory measurement document and do not replace the legal surveys and measurements — in France notably the “loi Carrez” or “loi Boutin” areas — which are the responsibility of the customer and of certified professionals. The customer remains solely responsible for the accuracy of the regulatory information in their listings.

Reconstruction relies on consumer capture technology: some surfaces (mirrors, large windows, very low-texture surfaces) may show imperfections inherent to that technology, without this constituting a defect in the service.

7. Content and ownership

Uploaded captures and the resulting 3D tours remain the property of the customer. The customer warrants that they hold the necessary rights over the properties captured (owner's consent or mandate) and over any people who may be visible. Dalim refrains from any use of customer content other than providing the service, except for tours explicitly designated as demonstrations by mutual agreement.

8. Personal data

The processing of personal data (accounts, captures and property addresses, visitor leads, tour statistics, billing data) is described in the Privacy policy, which forms an integral part of these terms. The customer, as controller of the leads collected through their tours, warrants that they inform the individuals concerned.

9. Liability

The service is provided “as is” during the pre-launch. The publisher's liability is limited to the amounts actually invoiced over the last three months — that is, during the pre-launch where nothing is invoiced, use without financial consideration or commitment on either side. Detailed liability clauses will be consolidated with legal counsel before the commercial launch.

10. Termination

The subscription is monthly and can be stopped at any time, effective at the end of the current month, by simple email. On termination, tours stop being served; the customer may request an export of their files within 30 days. During the pre-launch, access can be left at any time, without notice or formality: no subscription is running.

11. Governing law

These terms are governed by French law. Any dispute falls under the courts having jurisdiction over the registered office of the publishing company (stated on the Legal notice page upon registration), after seeking an amicable settlement.
